Building in Hamilton adds a real municipal layer on top of Ontario: Hamilton is one of the few Ontario cities that still requires a municipal Trade Licence, and building renovators and drain layers must pass a city-administered written exam to get it. Which code applies
Hamilton builds to the Ontario Building Code (the 2024 edition, in force since 1 January 2025) and the Canadian Electrical Code as adopted in Ontario. There is no separate city code. The Building Division reviews plans under the Ontario Building Code, and electrical, gas and the compulsory trades are regulated provincially by the Electrical Safety Authority, the TSSA and Skilled Trades Ontario respectively. What Hamilton adds is licensing, not a code.
Permits and inspections
Hamilton's Building Division uses an ePermitting portal for most permit types, with plans reviewed under the Ontario Building Code on a value-based fee. A straightforward new single detached typically processes in 10 to 20 business days after a complete application, and complex or new-subdivision work takes longer. Inspections follow the usual sequence: footings, foundation, framing, insulation and vapour barrier, plumbing and mechanical rough-in, and final. Permit fees are set by the city's fee schedule and change, so confirm the current figure on the Hamilton building-permits page rather than a number quoted elsewhere.
Local licensing
Hamilton requires a municipal Trade Licence under its Licensing By-law for plumbers, HVAC contractors, building-repair contractors, drain-repair contractors, sprinkler contractors and fire-protection contractors before they can pull a permit or work in the city. The licence is annual and the holder must also hold the relevant Skilled Trades Ontario Certificate of Qualification. - Urban Growth Boundary and Greenbelt. Work outside the urban boundary faces stricter scrutiny under the Greenbelt and Niagara Escarpment plans.
- Heritage conservation districts. Hamilton has several; exterior modifications need a Heritage Permit before the building permit.
Development charges and fees
Hamilton's development charges had been among the highest in the region, and the city has recently been cutting them: Council voted a temporary blanket discount and then extended and expanded it, effectively holding development charges below the standard rate on a temporary basis. Because the discount is a Council measure that can be revised at any vote, and because the standard rate itself is by-law-set and indexed, the live figure is genuinely in flux. Common mistakes
- Not allowing for the city exam. Building renovators and drain layers must pass it before the Trade Licence issues. Schedule it early.
- Missing the Niagara Escarpment step. A separate Development Permit can be required before the city building permit on escarpment lands.
